Today, Texas Nurse Practitioners joined two Texas nurse practitioners in filing a landmark constitutional lawsuit challenging Texas’ physician delegation requirement. At a time when Texas faces growing healthcare workforce shortages and increasing demand for primary care, the lawsuit seeks to remove unnecessary barriers that limit patients’ access to qualified healthcare professionals. The lawsuit challenges Texas’ collaborative-practice requirement under the Texas Constitution’s Due Course of Law Clause and nondelegation doctrine.
“Today’s filing marks an important new chapter in TNP’s decades-long effort to remove Texas’ unconstitutional barriers to patient care and give nurse practitioners the freedom to provide the care they are educated, trained, and licensed by the state to deliver. Texas cannot afford to leave qualified healthcare professionals on the sidelines while patients struggle to access care. We will pursue every appropriate avenue to ensure Texans have access to the healthcare they deserve.”
